1 ACCEPTANCE OF TERMS
1.1 These Terms and Conditions apply to all and any use of the website identified by the domain name 3SIXTEE.CO.UK ("the Website") including all and any postings, emails and other communications made to or using the Website, the purchase of any products or services available through the Website and all files, communications and information sent to you by 3sixtee ( a partnership) ("3sixtee").
1.2 You will not use the Website for any purpose that is unlawful in particular you will not commit or encourage a criminal offence; transmit or distribute a virus or post any material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Website; infringe upon the rights of any other person's proprietary rights; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website You will not use the Website for any purpose which is prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. 5.1 All copyright, trade marks (registered or unregistered including without limitation the mark, "3sixtee"), trade and business names, trade secrets, know-how and all other intellectual property rights in the Website and its content (including without limitation the Website design, text, graphics and all software and source codes connected with the Website) are owned by or licensed to 3sixtee or otherwise used by 3sixtee as permitted by law. All such rights of 3sixtee are hereby asserted and reserved.
5.2 In accessing the Website you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, reverse engineered, decompiled, sold or distributed without the prior written consent of the copyright holder. 3sixtee grants you a non-exclusive and non-transferable right and licence to download and print a single copy of this Website only to access and use this Website for your personal, non-commercial use and subject to these Terms. You may not sublicence or deal with this Website without 3sixtee's prior written permission.

6 TERMS OF SALE
6.1 Your placing of an order is an offer to purchase an item subject to these terms and conditions. All orders are subject to availability and confirmation of the order price. A contract between us will not be formed until we send you an order confirmation by e-mail.
6.2 Please note all prices advertised are subject to such changes. From time to time it may become necessary for 3sixtee to make alterations to prices and occasionally prices may be inaccurate or incorrectly displayed. In the event of any such change 3sixtee shall publish these on the Website and they shall become effective immediately upon publication. In addition if there is an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. All prices are quoted in pounds sterling.
6.3 Payment may be made by credit or debit card (currently VISA, Master Card and Switch/Solo) or by paypal. Such payments are subject to a credit check. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods.
6.4 A receipt confirming payment will be sent to the email address provided.
6.5 3sixtee may cancel any sale and not supply goods at any time at its sole discretion. In such cases 3sixtee will offer a full refund.
6.6 A confirmation email will be sent on dispatch of the item. We estimate that all orders will be ready for dispatch upto 2 weeks from the date of order. Delivery times may vary and as such we shall not be liable for any delay in delivery of products however caused. Risk of damage to or loss of the products shall pass to you at the time of delivery to the specified delivery address. During peak times demand can be very high and therefore delay in delivering items is sometimes out of our control, however we will notify you of any delays by email. 6.7 If your goods fail to arrive then you must contact us within 1 month of receiving your dispatched notification for us to investigate the delay and replace or refund you. After this period we deem that the goods have been delivered satisfactorily and no refunds or replacements can be made.
6.8 It is your responsibility to ensure that you order the correct item including the colour and size. Whilst 3sixtee are more than happy to assist you in your choice 3sixtee are not responsible for your decision. Since garments are made to order 3sixtee cannot refund you if the item/size/colour is found unsuitable. It is understood that an order, once it has been submitted and subsequently processed, cannot be cancelled upon commencement of the manufacturing process.
6.9 We are reliant on third party manufacturers for garments and as such continuity of supply to us is not guaranteed. We reserve the right to amend or change products styles without prior notice in order to deliver your product to you in the time frame stipulated.

7 COOKIES
7.1 In order to improve our service and Website we may use a device known as a 'cookie'. Cookies are a means by which information relating to your Internet activity (such as whether you have visited the Website before) is recorded on your hard drive and used by us to improve the Website.
7.2 If you do not wish for us to use cookies when you use the Website please adjust your Internet browser settings to not accept cookies. Your computer's help file should tell you how to do this.

8 DISCLAIMERS AND LIMITATION OF LIABILITY

8.3 3sixtee makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.
8.4 Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of 3sixtee for death or personal injury as a result of the negligence of 3sixtee or that of its employees or agents.

9 INDEMNITY
9.1 You agree to indemnify and hold 3sixtee and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against 3sixtee arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.

10 GENERAL
10.1 3sixtee acts as principal on its own account and not as agent for you or any other person.
10.2 If 3sixtee does not enforce any provision of these Terms and Conditions such will not be considered a waiver of any provision or right.
10.3 In the event that any part of these Terms and Conditions is held to be unenforceable, such part will at 3sixtee's option be construed as far as possible to reflect the parties' intentions and the remainder of the provisions will remain in full force and effect.
10.4 These Terms and Conditions constitute the entire agreement between you and 3sixtee and shall apply to the exclusion of all other terms or conditions of contract which you may purport to propose.
10.5 Since the Website is primarily aimed at the UK Market, 3sixtee cannot guarantee that it accords with the local laws of any other countries.
10.6 3sixtee will not be liable in any amount for failure to perform any obligation under these Terms and Conditions if such failure is caused by the occurrence of any unforeseen contingency beyond the reasonable control of such party including without limitation Internet outages, communication outages, fire, flood, war or act of God.

11 GOVERNING LAW
